Our platform offers tools, services, and resources for athletes, influencers, organizations, fundraisers, and businesses to create, sell, and manage custom collections, including Name, Image, and Likeness (NIL) merchandise. This includes seamless hosting, order fulfillment, shipping, returns management, and marketing support.
By accessing or using the site and/or purchasing a partnership or product, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service,” “Terms”), including additional terms and policies referenced herein. These Terms apply to all users, including browsers, vendors, customers, partners, and contributors of content.
Please read these Terms of Service carefully. By using any part of the website, you agree to these Terms. If you do not agree, you may not access the site or use the Services. We reserve the right to update or modify these Terms at any time. Continued use of the website following updates signifies your acceptance of the changes.
Our store and partnership services are hosted on Shopify Inc., which provides the e-commerce platform that powers K3T’s.
SECTION 1: ONLINE STORE AND PARTNERSHIP TERMS
By agreeing to these Terms, you confirm that:
1. You are at least the age of majority in your state or province or have received consent from a legal guardian.
2. You will not use our products, services, or partnerships for illegal or unauthorized purposes.
Failure to comply with these terms may result in termination of your account or partnership.
SECTION 2: GENERAL CONDITIONS
K3T’s reserves the right to refuse service to anyone at any time.
As part of using our Service:
• Content, except credit card information, may be transferred unencrypted across networks.
• You agree not to duplicate, reproduce, or exploit our Service, content, or access for commercial purposes without permission.
SECTION 3: PARTNERSHIP AND COLLECTION SETUP
By purchasing a K3T’s partnership, you gain access to the tools necessary to create, manage, and promote your custom collection. This includes services such as:
1. Custom Collection Pages – Featuring your bio, social media links, and your product listings.
2. Design and Listing Services – Including free design credits and monthly listing credits based on your tier.
3. Profit Sharing – Calculated based on sales from your collection, with payments processed monthly through CollabPay.
SECTION 4: PRODUCTION AND FULFILLMENT
All K3T’s items are produced on demand, meaning no upfront costs or inventory storage is required. Production costs are subtracted from the sales price before calculating profit payouts. Additional costs for larger sizes or extra print locations may apply, and these will be reflected in the production cost charts available in your Partnership Zone.
SECTION 5: PRODUCT SALES AND RETURNS
Products in NIL, organization, and fundraiser categories are not eligible for returns unless there is a manufacturer defect. Sales in these categories are final. For more information, view our Refund Policy.
SECTION 6: PARTNERSHIP PROFIT PAYOUTS
K3T’s uses CollabPay for secure, monthly profit payouts. Partners are responsible for keeping their payment account up-to-date. A 3% transaction fee applies to payouts. More details can be found in the Partnership Zone.
SECTION 7: MARKETING AND PROMOTION
Partners may purchase optional marketing add-ons, including promo videos, mock-ups, and social media formatted posts. These tools are available to maximize the visibility of your collection. Premium and MVP tiers offer discounted marketing services.
SECTION 8: INTELLECTUAL PROPERTY
All designs created by K3T’s, LLC remain the property of K3T’s. Partners agree that these designs may continue to be used commercially by K3T’s, even after the partnership period ends. Partners submitting their own artwork confirm they have the legal right to use the submitted content for commercial purposes.
SECTION 9: LIMITATION OF LIABILITY
K3T’s is not liable for any indirect, incidental, or consequential damages arising from the use of our Services or products.
